Kuptimi i vlerësimit të çështjes sipas situatës ligjore dhe faktike ekzistuese në kohën e kryerjes së veprimit administrativ apo në kohën e marrjes së vendimit. Ushtrimi i diskrecionit nga organi publik dhe kufijtë e shqyrtimit të tij nga gjykatat administrative. Kontrolli gjyqësor mbi (dis)proporcionalitetin e ndërhyrjes së organit publik, si dhe ndaj veprimeve administrative të kryera nga organet “quasi gjyqësore”. Hetimi gjyqësor në raport me hetimin administrativ në gjykimin e kësaj kategorie të çështjeve, në vështrim të nenit 37 të ligjit nr. 49/2012”.</p><p>Paneli në këtë aktivitet trajnues përbëhet nga:</p><p><strong>Ekspert: Z. The meaning of the evaluation of the case according to the existing legal and factual state in the time of the making of the administrative action or in the time of the taking of the decision.&nbsp;&nbsp;The exercise of discretion by the public organ and the limits of its examination by the administrative courts. Judicial control on (dis)proportionality of the interference of the public organ, as well as versus the administrative acts dome by the organs “almost judicial.” Judicial investigation in report to the administrative investigation in the judgment of this category of issues, in the view of the Article 37 of law no. 49/2012.”&nbsp;</i></p><p>The panel in this training activity is composed of:&nbsp;</p><p><strong>Experts:&nbsp;</strong>&nbsp;<strong>Mr. Sokol Sadushi, Mrs. Altina Nasufi</strong></p><p><strong>Facilitator:&nbsp;Mr. Sokol Ibi</strong></p><p>The main purpose of this training activity is the analysis of the limits of the examination of the case to the administrative court, the avoiding of duality for the reference to the applicable law for the resolution of the case, the space of the assessment of discretion of the public organ as well as of the proportionality of the measure, that is intended to be achieved in the consolidation of the judicial practice.&nbsp;</p><p><strong>In this training activity will be elaborated different topics, such as:&nbsp;&nbsp;</strong></p><ul><li>The meaning of the evaluation of the case according to the legal and factual existing state at the time of the commitment of the administrative action at the time of the taking of decision.&nbsp;</li><li>The exercise of discretion from public organ and the limits of its examination from the administrative court.&nbsp;</li><li>Judicial control on the (dis)proportionality of the interference of the public organ, as well as on the administrative actions performed by the “quasi judicial” organs.</li><li>Judicial investigation in relation to the administrative investigation in the judgment of this category of cases, under the view of the Article 37 of law no. 49/2012\".</li><li>Discussion of law and of case laws referring to judicial sentences, etc.&nbsp;</li></ul><p>Participants in this training activity are judges of the administrative courts as well as
